"Some remarks on the employment of analogy by the VI century's Greek jurists". This essay aims to examine the different types of analogical reasoning employed by the jurists of the Eastern Empire, who translated Justinian's legislation into Greek, and to evaluate their extent. First of all, the Author proceeds to study the Greek versions of the texts collected in D. 1.3 concerning the analogical reasoning. Regarding the one inserted in the "Basilicorum libri", it comes to mind that its anonymous author thinks analogy belonging more to the sphere of interpretation than to the sphere of the creation of law; besides, he holds as a type of analogy even applying to future cases the solution given to a previous one. The second problem faced is whether Justinian, in his constitution "Tanta", intended to prevent the jurists from analogical reasoning: according to the Author, such a point is uncertain; nevertheless, it is a fact that no one of the "Novellae" concerns the use of analogy. Thirdly, the Author examines the scholies to Bas. 8.1-2 and to Bas. 11.2 belonging to Thalelaeus, and observes that the analogical reasoning is employed to extend single cases, instead of extending abstract juridical norms; by contrast, the epitomists of Justinian's Novels use such reasoning in order to specify the extent given to a law, but only rarely and along with other arguments. - Scopo del saggio è di contribuire a valutare le forme e il peso che il ragionamento analogico ha assunto presso i giuristi dell'Impero d'Oriente che resero in greco la legislazione di Giustiniano. In primo luogo esso studia le versioni a noi note dei passi di D. 1.3 relativi al pensiero analogico e rileva come l'anonimo autore di quelle accolte nel testo dei Basilici ritenga che l'analogia rientri nell'ambito dell'interpretazione piuttosto che della creazione del diritto e la consideri esistente anche quando si tratta di applicare la soluzione di un caso concreto ad altri futuri. Il secondo problema affrontato è l'eventualità che Giustiniano nella costituzione "Tanta" abbia voluto precludere ai giuristi il ragionamento analogico: secondo l'A., il punto è incerto, ma in nessuna delle Novelle conservate viene sottoposto al sovrano un dubbio sull'uso dell'analogia. In terzo luogo, l'A. osserva che nei passi di Taleleo presenti negli scolii a Bas. 8.1-2 e 11.2 il ragionamento analogico opera per estendere casi piuttosto che norme; che invece gli epitomatori delle Novelle lo usano quasi solo per precisare l'estensione di una norma, ma di rado ed accanto ad altri argomenti.
