L'opera analizza la dissociazione fondamentale tra declamazioni e regole operazionali applicate nei singoli sistemi giuridici di tradizione romanista in relazione alle fattispecie di formazione dell'accordo contrattuale e di trasferimento della proprietà. ENGLISH: The book presents an intellectually challenging overview both of contract law and of property law. In the first direction, it offers a clear and accurate explanation of the Law of Contract, presented in a systematic and logical order. The main objects are the analysis of the elements of contract and the understanding of contract formation. In the second perspective, the monograph offers an in-depth examination of the key theoretical concepts of the Law of Property and especially it critically scrutinizes the different ways in which property is transferred according to the competing models embedded in the civil law tradition. The comparative methodology allows the Author to unmask and unveil the actual dissociations among declamations and operational rules, as they are expressed by the main legal formants of each legal system within the Civil Law tradition.
