Beni culturali demo etno antropologici

Lo studio si propone di analizzare l’evoluzione normativa dei beni culturali con particolare attenzione ad una nuova categoria quella dei beni demo etno antropologici che ha trovato una prima identificazione nella legge n. 1089 del 1939 in uno con l’affermarsi degli studi etnografici dell’inizio del novecento, per registrare un più puntuale riconoscimento solo con il T.U. sui beni culturali del 1999. L’indagine mette tuttavia in evidenza la particolarità di tale tipologia di beni culturali, data dalla “immaterialità”, e denuncia come il sistema normativo delineato dal Codice dei beni culturali del 2004-2008 abbia trascurato tale categoria di beni in quanto prevalentemente orientato alla tutela e alla valorizzazione dei soli beni culturali “materiali”. Tale constatazione offre lo spunto per un opportuno ripensamento sugli indirizzi ed orientamenti normativi a salvaguardia di un importante patrimonio culturale a rischio di estinzione ed oblio. The study aims at analysing the development of cultural heritage related regulation, specifically, it focuses on a new heritage category, the demo-ethno-anthropological. Such category of heritage has found an initial, but partial, recognition by the law nr. 1089/39 together with the establishment of the ethnographical studies at the beginning of the twentieth century and, later, it has found proper recognition within the T.U. of cultural heritage issued in 1999. However, the research highlights the peculiarity of such typology of heritage, given its “intangibility”, as well as addressing how the current regulation driven by the Code cultural heritage, dating 2004-2008, has completely disregarded such category because of its relevant focus on valorising and defending only “tangible” heritage. The findings offer the opportunity for an appropriate rethinking of the directions and orientation of the regulation in order to safeguard such an important cultural heritage which is now facing the risk of extinction and oblivion.
