The goal of this paper is to reflect on the notion of ‘parenthood’ in the light of change in family patterns and of the impact that the international and Eu level has had on it. To identify the notion of ‘parent’ and “offspring” we need to consider not only the declamations of principle that are sometimes found in the legal framework (for instance that the mother is proven by giving birth, according to the mater semper certa est doctrine), and also look concretely at the relationship between a child and his or her principal caregiver to whom law and regulations attribute rights and responsibility as a consequence of that factual role. Thus, we specifically focus on the role of conciliation policies, illustrating will illustrate how and if the various forms and ways of experiencing and understanding parenthood are supported through social policy, as well as recognized in civil law.
