The paper examines the impact of robotics technology on criminal law by distinguishing between the “Picciotto Roboto” and the “Robot Kleptomaniac,” that is, between robots that participate or are used in criminal enterprises and, vice versa, robots that choose to commit and, ultimately, carry out an offence. On one hand, the aim is to prevent some exaggerations, popular in the legal field, by showing that “autonomous” and even “intelligent” robots should not be liable. On the other hand, we need no Sci-Fi scenarios to admit a new generation of criminal cases and of ethical issues brought on by the information revolution. Even “Picciotto Robotos,” after all, do affect basic tenets of the law such as notions of human responsibility, reasonable foreseeability, apportioned liability, and causation.
