Il Consiglio delle autonome locali nella prospettiva dell'azione legislativa regionale

Constitutional Law no. 3/2001, reforming the Italian regional system established a Consiglio delle Autonomie locali (CAL), as an obligatory institution for f ordinary regions. This work proposes a particular interpretation of the role that is assigned to the CAL, imagining a possible strengthening of the relations between the CAL and the regional Councils in a bicameral sense. All this, of course, fully aware that in the Italian legal system all law- making power at the regional level is conferred on regional Councils. Finally, the Author evaluates the benefits of a possible intervention of the CAL in many fundamental matters, whose implications with some topical national issues are evident. For example, one must think at the points related, on one hand, to Fiscal federalism or to Fiscal Compact; on the other, to the realization of the asymmetrical decentralization’s process in accordance with the subsidiary principle.
