The paper tries to describe the procedure of the questione prejudicielle in Belgium, to emphasize the characteristics of judicial review which seems to underline once again the origins of the Cour constitutionnelle that was created primarily as a judge of conflicts between federal entities and the state. The judgment declaring the uncostitutionality of the norm has only inter partes effects, with obvious consequences on the applicability of the provision in future cases.
