This work examines the last decision of the Italian Supreme Court that allows the appeal against an award for infringements of rule of law concerning the fact even if the arbitration clause was introduced before the last reform dated 2006. The author agrees with the decision and reviews its argumentations and concludes with a remark on the case of arbitration clauses introduced in companies’bylaws before 2006 but after the company law reform (effective January 1st, 2004).
