Il ruolo della trasparenza in materia di aiuti di Stato

The paper analyses the essential role played by the rules on transparency in the enforcement of State aid law, focusing on both specific rules regarding the transparency of financial transactions and general rules regarding the access to information and documents related to potential recipients of State aid measures. Transparency is also addressed as a tool to ease the opening up of new markets to competition. The focus is on the specific transparency requirements set by the EU Regulation n. 1370/2007 on railway transport and the related recent string of national administrative case law, which out-lined the deep interaction between transparency and State aid rules in this sector.
