Over the last decades, the ICHR showed an evident reluctance in the application of the margin of appreciation doctrine. Meanwhile, especially after its legislative recognition in the 15th Protocol, The European scholars were debating about the nature of the margin and how to improve the correct use of it. This work aims to analyse the possible different reasons behind the reluctance by the Interamerican Court, recognizing the need to reflect about the application of the margin of appreciation and about any possible misunderstandings, compromising its spread in the Latin American region.
