Coronavirus is involving each aspect of our lives, both individually and collectively: it is challenging all sciences, included constitutional law. The paper explores various attitudes towards coronavirus health emergency by constitutionalists and it points out that, at least in the first period of restrictive measures, Italian people showed a collaborative spirit, which seems now disappeared. This collaborative spirit can be described as an artificial and deliberate attitude which arises from the awareness of the destructive tendencies caused by exasperated individualism. This awareness allows to conceive a pregnant meaning of the constitution (“functional constitution”).

Abstract

Coronavirus is involving each aspect of our lives, both individually and collectively: it is challenging all sciences, included constitutional law. The paper explores various attitudes towards coronavirus health emergency by constitutionalists and it points out that, at least in the first period of restrictive measures, Italian people showed a collaborative spirit, which seems now disappeared. This collaborative spirit can be described as an artificial and deliberate attitude which arises from the awareness of the destructive tendencies caused by exasperated individualism. This awareness allows to conceive a pregnant meaning of the constitution (“functional constitution”).
