Abbandonare la strada vecchia per quella nuova: l’efficacia dei provvedimenti di kafalah a seguito dell’entrata in vigore della Convenzione dell’Aja del 1996 (nota a Trib. min. Emilia-Romagna, decreto del 14 marzo 2019)

This paper aims to analyse a recent Bologna Juvenile Court judgment on the enforcement of Moroccan kafala in Italy. The Italian legal system provides various legal tools to enforce kafala. This work focuses on art. 66 of 218/1995 Act on automatic recognition of judgments on undisputed matters, as well as on the 1996 Hague Convention on Parental Responsibility and Protection of Children. Moreover, it concludes with a final analysis on the interaction between these two legal instruments, suggesting an autonomous application of the 1996 Hague Convention.
