The paper analyzes the judgment no. 37/2021 of the Constitutional Court, which declared illegitimate the Valle d'Aosta Region law no. 11/2020, concerning the regulation of the health emergency Covid-19 in the regional territory. The work proposes some reflections on the critical aspects of the Court’s decision, which concern the enlargement, compared to the past, of the matter of «international prophylaxis» (art. 117 paragraph 2, lett. q) of the Constitution) and the limitation of the scope of principle of «loyal collaboration» between the State and the Regions, that connotes the Title V of the Second Part of the Constitution since at least 2001.
