From the point of view of constitutional law the juxtaposition of the two terms - globalization and religions - seems particularly fruitful, because, on the one hand, religions have to be considered as potentially conflicting world views which, as such, need to be subjected to that process of pacification theorized by second post-war constitutionalism, and, on the other hand, because globalization has been the main factor of crisis of national state where up to now that process of pacification has been practiced. For these reasons the juxtaposition of the two terms could be useful to think of a process of constitutionalization at a global level, but this global constitutionalism would be without political law.

Abstract

From the point of view of constitutional law the juxtaposition of the two terms - globalization and religions - seems particularly fruitful, because, on the one hand, religions have to be considered as potentially conflicting world views which, as such, need to be subjected to that process of pacification theorized by second post-war constitutionalism, and, on the other hand, because globalization has been the main factor of crisis of national state where up to now that process of pacification has been practiced. For these reasons the juxtaposition of the two terms could be useful to think of a process of constitutionalization at a global level, but this global constitutionalism would be without political law.
