Due proposte. * L’articolo analizza il tema della trasmissione del cognome ai figli, ancora sospeso, in Italia, tra riforme abbozzate in Parlamento e nuove sentenze annunciate della Corte costituzionale. Diverse ragioni lasciano presagire, sul modello di quando accaduto in altri ordinamenti europei, che l’assetto normativo che alla fine si sedimenterà si fonderà sull’autonomia privata e stabilirà, come regola residuale, il doppio cognome, verosimilmente in ordine alfabetico. Lo scritto analizza criticamente l’eccesso di fiducia riposto sull’autonomia dei privati e, inoltre, stigmatizza le esternalità negative che il criterio alfabetico avrebbe sulla ricchezza del patrimonio onomastico italiano, che verrebbe depauperata col trascorrere delle generazioni. Vengono dunque proposti due sistemi alternativi fondati, il primo, sul criterio statistico della prevalenza del cognome meno diffuso e, il secondo, sul criterio della prevalenza del cognome del genitore avente il medesimo genere del figlio. In forza di tale criterio, di cui vengono ricostruite le origini storiche e culturali, si dovrebbe attribuire ai figli il cognome paterno e, alle figlie, il cognome materno. * This paper analyzes the problem of the transmission of parents’ surname to children, still suspended, in Italy, among reforms drafted in Parliament and new sentences announced by the Constitutional Court. Several reasons suggest, similarly to the model in force in other European systems, that the future regulatory framework will be based on private autonomy and will establish, as a residual rule, the double surname, probably in alphabetical order. The paper critically analyzes the excess of trust placed on the autonomy of individuals and, moreover, stigmatizes the negative externalities that the alphabetical criterion would have on the Italian onomastic variety. Two alternative systems are therefore proposed: the first is based on the statistical criterion of the prevalence of the less common surname; the second, on the criterion of the prevalence of the surname of the parent having the same gender as the child. According to this criterion, whose historical and cultural origins are reconstructed, the sons would inherit the paternal surname and the daughters the maternal one.
