The article deals with some paradigmatic cases of the complex relationship between domestic and EU sources in the field of economic freedoms. After briefly considering the original framework of the Italian economic constitution, it focuses on a number of particularly relevant areas in which the impact of EU law has recently manifested itself. The conclusion submits that such impact should be read and assessed differently from what seems to be the widely prevailing consensus in the legal scholarship and case-law.

Abstract

The article deals with some paradigmatic cases of the complex relationship between domestic and EU sources in the field of economic freedoms. After briefly considering the original framework of the Italian economic constitution, it focuses on a number of particularly relevant areas in which the impact of EU law has recently manifested itself. The conclusion submits that such impact should be read and assessed differently from what seems to be the widely prevailing consensus in the legal scholarship and case-law.
