While in Italy the formal constitutionalization of the environment has not yet been completed, in France the inclusion of the Charter of the environment in the so-called "block of constitutionality" has strengthened the role of active citizenship, in environmental matters, of each citizen, giving him not only rights, but also duties. This paper focuses on the institution of the obligation réelle environnementale as a tool available to the private landowner to achieve the ecological function of the property.

Abstract
