This paper aims to look for elements of democracy in the origins of the monastic chapter. These elements should be preserved and re-proposed in the legal instruments of civil law that could be most suitable for the management and the reuse of decommissioned monasteries and convents. Starting from the configuration of these goods as “common goods”, the legal instruments of cooperation pacts, participatory foundations and trusts could return these assets to the community as an opportunity of participation and democracy for the whole civil society.
