The fact that an offense can be committed by artificial intelligence seems to be an oxymoron, at least in a legal system where criminal acts are, by definition, an expression of the personality of a human being. However, reality is knocking on the door of criminal lawyers, challenging them with the possibility that a non-human agent may commit harmful acts that the com munity would want to be punished. This paper questions the prospects of a rational criminal control with respect to acts performed by or through machines and software that learn and evolve by interacting with the environment in which they act.
