The Italian damages system, like the French system, does not offer an adequate general solution in cases of unlawful profit, i.e. where someone enriches themselves at the expense of another person without a valid reason. The purpose of this study is to examine the various solutions that have been proposed for reversing the unjust profit obtained by the wrongdoer, either by resorting to restitutive remedies or by taking the path of reparation, i.e. civil liability.

Abstract
