“Detention” is a crucial concept in the EU judicial cooperation framework. In the absence of a common normative definition, the EU Court of Justice construed “detention” as anautonomous concept of EU law in the JZ case. This article aims at illustrating the Court’s reasoning in JZ and the system ici mplications of that autnonomous notion on the judicial cooperation framework. In this sense, the European Supervision Order Framework Decision is selected as a case-study, demonstrating how the notion as framed in JZ may not fit all judicial cooperation instruments. These considerations are finally integrated in the braoder debate on the establishment of common EU rules on detention.
