Among the subjects susceptible to differentiated autonomy is “labor protection and security”, which falls, today, under concurrent legislative power. To understand the scope of a devolution of such a complex matter to the regions, a preliminary reflection on the meaning of the right to work as a fundamental right of a social nature and the articulation of its protection in the different levels of government is necessary. It is only the correct framing of the attributions of public powers and administrative apparatuses, as well as the identification of the resources allocated for the performance of these attributions, that makes it possible to understand to what extent and with what accuracy and, indeed, at what level, the system is best able to pursue the guarantee of this fundamental right.
