The article presents the judicial model represented by the Unified Patent Court (UPC). The UPC is a unique judicial body established by an international agreement and defined as a court common to the contracting States. As such, it is embedded in the EU judicial system. Against this background, the article discusses the UPC's power and duty to refer questions for preliminary ruling to the Court of Justice of the European Union.
