In the course of the Covid-19 pandemic, the protection of the right to health has been articulated, in the state-region interaction, around the adoption of a series of measures, at the national and regional levels, whose prescriptiveness, in the framework of the sources of law, has raised relevant questions, legitimizing in fact different practices and behaviors by individual territorial authorities. It is evident that inhomogeneities in different regional health care systems existed even before the Covid-19 pandemic. However, analyzing how these systems were able to cope with the emergency is a useful tool to put in the right light the risks that may arise, precisely with reference to the effectiveness of health protection, from a distortion of the "constitutional idea" of equality, autonomy and differentiation in access to health services.
