In this contribution I will investigate the feasibility and usefulness of the intersectional approach concerning judicial proceedings related to cases of violence against women. First, I will focus on the phenomenon identified by Miranda Fricker as epistemic injustice, highlighting the specific traits that characterize the cognitive mechanisms informing judicial evaluations and discursive practices that reinforce the gender-based power structures. Secondly, I will highlight how the intersectional approach, taking into account the multiple and intersecting identities that characterize individuals, can support in correctly defining agency, by clarifying the conditions of consent.
