The present article intends to analyse the regulatory provisions disincentivising parliamentary mobility introduced in the 2017 and 2022 in order to verify the existence of any profiles of conflict with article 67 of the Constitution and the incisiveness of the same in contrasting parliamentary mobility. The article concludes with an observation on the need to link the intervention on the regulation of parliamentary groups to broader reformist logics that take into account, for example, a reform on political parties.

Abstract

The present article intends to analyse the regulatory provisions disincentivising parliamentary mobility introduced in the 2017 and 2022 in order to verify the existence of any profiles of conflict with article 67 of the Constitution and the incisiveness of the same in contrasting parliamentary mobility. The article concludes with an observation on the need to link the intervention on the regulation of parliamentary groups to broader reformist logics that take into account, for example, a reform on political parties.
