Starting from the recognition, in the context of balancing constitutional rights, of the link between the essential minimum content of rights and constitutionally necessary expenditures, the article criticizes the current funding system of the National Health Service. This system is based — regarding both the determination of the total amount of the National Health Fund and its distribution among the regions — on political choices that are formally disconnected from the definition of the essential levels of care (which do not fully respect the essential minimum content of the right to health) and their standard costs: in violation of what is established by the Constitution.
