"Al maschio la parte di due femmine": regole e pratiche successorie nell'Islam

The sex of the heir determines the extent of their right and the male is favoured over the female. These rules characterise inheritance, the most sacred and formally intangible core of the šarī'a. The special formal sta- tus of the inheritance system, however, has never prevented the spread of practices that, depending on the case, further compressed women’s rights or aimed to establish a different balance between their interests and those of males. Nor does it prevent trabs today from proposing their reform through legislation. This contribution will consider these issues from the perspective of foreseeable adaptations in the European context.
