The mutual recognition of freezing and confiscation orders has posed a significant challenge for judicial cooperation within the EU, primarily due to national disparities in substantive and procedural law. In an effort to harmonise this domain and mitigate “implementation issues”, the Union adopted Regulation (EU) 2018/1805. Despite this milestone, some Member States have decided to implement concurrent national rules on the matter. This article will show how the individual policies risk undermining the overarching objective.
