Organisational fault has been part of legal vocabulary for several years now, but the increased frequency with which the term is mentioned in case law has been accompanied by a geometric trend towards misunderstanding, confusion and overlap with individual negligence. It is therefore necessary to retrace the evolution of the concept and then try to outline its potential for use in certain areas destined for future development in terms of regulation and application: from groups of companies to value chains.
