Il giudice e il recidivo: riflessioni su facoltatività ed effetti indiretti ex art. 99 c.p

Nell’approfondire il tema dei rapporti tra effetti diretti e indiretti della recidiva, il presente contributo affronta la questione dell’incidenza di eventuali elisioni o temperamenti dell’innalzamento di pena ex art. 99 c.p. sulla produzione, a valle, di effetti minori. Da una parte, si colloca il problema delle conseguenze dell’aumento temperato di pena, ex art. 99, comma 6, c.p., recentemente affrontato anche dalle Sezioni unite della Cassazione; dall’altra, il tema dei riflessi del giudizio di bilanciamento delle circostanze, specie se definito nel senso della subvalenza della recidiva. (ENG) By investigating the relationship between direct and indirect effects of recidivism, the present work focuses on the production of minor effects in the event of elimination or attenuation of the aggravating factor ex art. 99 Criminal Code. On the one hand, the subject of the consequences of a temperate increase of the final sentence, ex art. 99, comma 6, Criminal Code, as recently discussed by the United Sections of Cassation, will be inquired; on the other, some focus will cover the issue of how the balancing of circumstances can affect minor effects set forth by law, especially when the recidivism has been deemed recessive.
