This essay examines the relationship between migration and the territorial dimension of the European Union, challenging the widespread narrative of a permanent “migration emergency”. It argues that contemporary migration towards Europe should not primarily be understood as a quantitative problem, but rather as a question of governance, distribution, and political perception. The paper highlights the tension between the universal aspiration to a right to migrate and the sovereign power of states to control their territories and borders, identifying this opposition as a fundamental constitutional and political dilemma.
