Riflessioni sui beni comuni tra il "pubblico" e la Costituzione

I beni comuni hanno il fascino potente del nuovo, della corsa verso l’oltre, ma cosa sono? Il saggio, cogliendo la sfida del “comune”, ne ricerca una definizione, individuandone il fil rouge nella funzione (la salvaguardia e la fruizione comune del bene), per poi rilevare le ambiguità e le domande sollevate dal “di chi sono” e dal “come funzionano” i beni comuni, ovvero dalla loro titolarità diffusa e gestione partecipata. Si approda così all’immaginario che i beni comuni veicolano, al loro potenziale trasformativo e dirompente nei confronti della proprietà, della sovranità e del pubblico. I beni comuni scardinano il paradigma proprietario e la logica del profitto, sfidano la sovranità e lo Stato, ma perché “oltre il pubblico”? Una domanda scomoda, ma ineludibile, se si muove dal “pubblico” del costituzionalismo. È una questione che si lega al rapporto fra beni comuni e Costituzione: un’amicizia che traspare accostando la prospettiva dei beni comuni a principi e norme costituzionali. Il saggio si chiude, infine, con una suggestione sul paesaggio come bene comune tutelato dalla Costituzione e una riflessione sulla tensione rivoluzionaria dei beni comuni, visti non come mantra magico per evocare il mondo nuovo, ma come un oltre che, nel proiettarsi verso un futuro altro da immaginare e da costruire, poggia sulle spalle delle lotte del Novecento. The commons have the charm of the new, but what are they? The essay, accepting the challenge of the “common”, looks for a definition, identifying the common thread in the function (the preservation and enjoyment of the common good), and then detects the ambiguities and questions raised by “whose they are” and “how they work” by their widespread ownership and participatory management. This leads to the transformative potential and disruptive nature of the commons against property, sovereignty and the public. The commons unhinge the paradigm of property and the logic of profit. They challenge sovereignty and the State, but because they also appear to be “beyond the public”? An awkward question, but unavoidable if it is raised by the “public” of constitutionalism. It's a question linked to the relationship between the Constitution and the commons: a kinship that is revealed through the association between the perspective of the commons and constitutional rules and principles, viewing the commons as a constitutional expression. The essay closes with a suggestion for the landscape of common and constitutional good, and a reflection on the revolutionary tension of the commons, seen not as a magical mantra to summon the new world, but rather as a projection for an alternative future that leans on the shoulders of the achievements of the twentieth century.
