This paper explores the contribution of the European Court of Human Rights and the Court of Justice of the European Union in the building of European private law, with specific regard to property law. It focuses on the case law of the two European Courts dealing with alleged violations of property rights1. Case law is, indeed, the very core of European Convention on Human Rights law, while it is just one aspect of a more complex legal framework for property rights protection within European Union law.
