Il mosaico dell’arbitrato al tempo del Codice della crisi: nouvelle vague o antiche aporie?

The author analyses the rules on arbitration in the light of the 2019 reform of Insolvency law. First of all, the author describes the new face of the law, highlighting how many rules reproduce the actual bankruptcy law: in the field of arbitration, the new insolvency law do not provide any new rule, although the actual rules were really defective (§ 1). After the premises, the author investigates the different facets that concern the new law and the arbitration proceeding: what disputes can be decided by arbitration (§ 2); if the arbitration can apply during the twilight period (§ 3), in the over-indebtedness procedure (§ 4) or in the court settlements of the crisis (§ 5). The core part of the article is devoted to the examination of the old/new “liquidazione giudiziale” (former bankruptcy procedure: §§ 6-10). The last part considers possible action to modify the new insolvency law (§ 13).
