Lavoro agile e smart working emergenziale: gemelli diversi

Benché nella situazione di straordinaria emergenza derivante dalla pandemia da Covid-19 il Governo abbia fatto ricorso allo schema normativo del lavoro agile al fine di garantire il proseguimento delle attività lavorative salvaguardando la tutela della salute, lo strumento applicato mediante una decretazione d’urgenza e frastagliata differisce per aspetti tutt’altro che irrilevanti dall’istituto regolato dal legislatore con la l. n. 81/2017. Il saggio si propone dunque l’obiettivo di analizzare similarità e differenze fra gli istituti che compongono la famiglia del lavoro da remoto, evidenziando in particolar modo i caratteri tipici e innovativi del lavoro agile e ponendone in luce le differenze rispetto allo smart work emergenziale. L’a. si sofferma inoltre sulle più recenti novità – soprattutto di natura contrattual-collettiva – apportate per fronteggiare i principali problemi emersi dall’esperienza applicativa degli ultimi due anni, in vista del graduale ritorno alla normalità. In the emergency situation due to the Covid-19 pandemic, the Government used the regulatory scheme of agile work to ensure the continuation of work activities while safeguarding health protection. However, the tool applied in the emergency phase differs from the one governed by Law No. 81/2017 in very relevant aspects. The essay aims to analyze similarities and differences between the various models of remote work, highlighting in particular the typical and innovative features of agile work and the differences with smart work in emergency. The a. also focuses on the most recent innovations made to address the main issues that have emerged from the experience of the past two years, in view of the gradual return to normality.
