Il diritto all’oblio e la portata globale dei provvedimenti del Garante per la protezione dei dati personali secondo la giurisprudenza italiana

This contribution offers an analysis of the decision of 24 November 2022 no. 34658 by the Italian Court of Cassation (Ordinanza della Corte di cassazione), regarding the right to be forgotten of a data subject seeking protection by means of de-indexing from the Google search engine. The major novelty of the decision is the fact that the Italian courts allow global de-indexing. This contribution has a twofold purpose: on the one hand, investigating the extraterritoriality profiles of national data protection measures in light of the reasoning proposed by the Court and, on the other hand, examining which elements justify the request for protection of the right to be forgotten also beyond the EU Member States. Against this backdrop, then, the contribution construes the Court’s intervention as an expression of a pragmatic-functional approach, which aims to guarantee maximal protection for the fundamental right to personal data protection.
