Despite significant progress in various areas of social life, the rights of persons with disabilities in Italy remain poorly defined, and pervasive forms of symbolic violence persist, as evidenced by their participation in economic and working life. This is partly due to legislative inertia in implementing measures to ensure the enforceability of the right to nondiscrimination in access to employment and in the workplace for people with disabilities. This contribution highlights how such inertia stems from an incomplete process of cultural civilization and identifies two key, complementary directions to advance this process: the shift towards a disability conception based on the capability approach, and an understanding of organizations as decision-making processes intrinsically tied to the subjects involved. The paper concludes with some suggestions, drawn from these perspectives, for implementing the principle of reasonable accommodation in domestic law.
